USE POLICY
THE OLD NORTH CHURCH OF NORTH DANVILLE, VERMONT
(A PROPERTY OF THE DANVILLE, VERMONT, HISTORICAL SOCIETY, INC.)
STATEMENT OF PURPOSE: The Danville, Vermont, Historical Society, Inc. (referred to in this document as the Danville Historical Society) owns the Old North Church building that is located on Old North Church Road in North Danville, Vermont. The property is subject to a deed condition that the “premises be used only for events connected with religious or historical purposes.”
The Danville Historical Society wishes to make the Old North Church premises available for use in a manner that complies with this requirement and is appropriate to the nature and condition of the premises. It is the intent to have the premises used as frequently as possible, but it is the obligation of the Society to ensure that the Old North Church is maintained in good condition and its use and maintenance do not create an undue financial burden or cause damage or excessive wear to the historic building. This policy is intended to help ensure that the Old North Church will be well maintained, enjoyable, accommodating, and will provide a safe environment, and that the Danville Historical Society will be fair and consistent with all parties wishing to use its facility.
1. PRIORITY OF USE. The Danville Historical Society will make the Old North Church available on a limited, first-come-first-serve basis for individuals, groups and organizations to rent during times when the facility is not being utilized for Danville Historical Society or Old North Church Committee programs or sponsored events. It will be rented based on the availability of Old North Church Committee members to facilitate and supervise the designated event.
2. NON-DISCRIMINATION. The facility is available to all qualified users on equal terms in accordance with state and federal non-discrimination laws for religious or historical purposes.
3. AVAILABILITY. The facility is available for use from Memorial Day through September 30.
4. PROHIBITIONS. The use of the facility is limited to purposes and events connected with religious or historical purposes. The following uses are strictly prohibited at the facility.
a. No food or drink may be served on the premises. This requirement may be waived for use of the facility by the Danville Historical Society or the Old North Church Committee.
b. Smoking is prohibited in or around the Old North Church.
c. The serving or possession of alcohol on the premises is prohibited.
5. RENT AND SECURITY DEPOSIT. A schedule of rent and security deposits to be charged for various uses of the premises shall be established by the Old North Church Committee of the Danville Historical Society and adjusted annually, or at the Committee’s discretion.
6. SECURITY. The Old North Church Committee may request the presence of security officer dependent on the size of the group or the nature of the event.
7. OBLIGATIONS OF USERS. Users must return the facilities in a neat, orderly and clean condition after their use. Users will be responsible for, and liable to, the Danville Historical Society for all repairs to the facility required as a result of damage caused by users. Users must comply with all local, state, and federal laws and rules of the Danville Historical Society. Users must indemnify and hold the Danville Historical Society, its officers, agents, and employees harmless from any loss or liability which may result from claims of injury to persons or property from any cause arising out of or during the use and occupancy of the Old North Church by User and User’s guests, agents, or employees.
8. Facility Rental Agreement. Social service and community service groups, individuals, businesses, and non-profit groups wishing to use the facilities shall be required to execute a Rental Agreement for each event.
9. Termination of Rental. The Danville Historical Society, or the Old North Church Committee, its officers, agents and employees shall have the right to enter and be present at the premises at all times during an event to confirm that the user is complying with the terms of use. If the Danville Historical Society, or the Old North Church Committee, determines, in its sole judgment, that the user has breached a term, the Danville Historical Society, or the Old North Church Committee, shall have the right to immediate termination of the use of the rental agreement prior to the expiration of its term and prior to the conclusion of the event without any refund to the User.
