USE POLICY
THE OLD NORTH CHURCH OF NORTH DANVILLE, VERMONT

STATEMENT OF PURPOSE: The Danville, Ver­mont, His­tor­i­cal Soci­ety, Inc. (referred to in this doc­u­ment as the Danville His­tor­i­cal Soci­ety) owns the Old North Church build­ing that is locat­ed on Old North Church Road in North Danville, Ver­mont. The prop­er­ty is sub­ject to a deed con­di­tion that the “premis­es be used only for events con­nect­ed with reli­gious or his­tor­i­cal purposes.”
The Danville His­tor­i­cal Soci­ety wish­es to make the Old North Church premis­es avail­able for use in a man­ner that com­plies with this require­ment and is appro­pri­ate to the nature and con­di­tion of the premis­es. It is the intent to have the premis­es used as fre­quent­ly as pos­si­ble, but it is the oblig­a­tion of the Soci­ety to ensure that the Old North Church is main­tained in good con­di­tion and its use and main­te­nance do not cre­ate an undue finan­cial bur­den or cause dam­age or exces­sive wear to the his­toric build­ing. This pol­i­cy is intend­ed to help ensure that the Old North Church will be well main­tained, enjoy­able, accom­mo­dat­ing, and will pro­vide a safe envi­ron­ment, and that the Danville His­tor­i­cal Soci­ety will be fair and con­sis­tent with all par­ties wish­ing to use its facility.
1. PRIORITY OF USE. The Danville His­tor­i­cal Soci­ety will make the Old North Church avail­able on a lim­it­ed, first-come-first-serve basis for indi­vid­u­als, groups and orga­ni­za­tions to rent dur­ing times when the facil­i­ty is not being uti­lized for Danville His­tor­i­cal Soci­ety or Old North Church Com­mit­tee pro­grams or spon­sored events. It will be rent­ed based on the avail­abil­i­ty of Old North Church Com­mit­tee mem­bers to facil­i­tate and super­vise the des­ig­nat­ed event.
2. NON-DISCRIMINATION. The facil­i­ty is avail­able to all qual­i­fied users on equal terms in accor­dance with state and fed­er­al non-dis­crim­i­na­tion laws for reli­gious or his­tor­i­cal purposes.
3. AVAILABILITY. The facil­i­ty is avail­able for use from Memo­r­i­al Day through Sep­tem­ber 30.
4. PROHIBITIONS. The use of the facil­i­ty is lim­it­ed to pur­pos­es and events con­nect­ed with reli­gious or his­tor­i­cal pur­pos­es. The fol­low­ing uses are strict­ly pro­hib­it­ed at the facility.
a. No food or drink may be served on the premis­es. This require­ment may be waived for use of the facil­i­ty by the Danville His­tor­i­cal Soci­ety or the Old North Church Committee.
b. Smok­ing is pro­hib­it­ed in or around the Old North Church.
c. The serv­ing or pos­ses­sion of alco­hol on the premis­es is prohibited.
5. RENT AND SECURITY DEPOSIT. A sched­ule of rent and secu­ri­ty deposits to be charged for var­i­ous uses of the premis­es shall be estab­lished by the Old North Church Com­mit­tee of the Danville His­tor­i­cal Soci­ety and adjust­ed annu­al­ly, or at the Committee’s discretion.
6. SECURITY. The Old North Church Com­mit­tee may request the pres­ence of secu­ri­ty offi­cer depen­dent on the size of the group or the nature of the event.
7. OBLIGATIONS OF USERS. Users must return the facil­i­ties in a neat, order­ly and clean con­di­tion after their use. Users will be respon­si­ble for, and liable to, the Danville His­tor­i­cal Soci­ety for all repairs to the facil­i­ty required as a result of dam­age caused by users. Users must com­ply with all local, state, and fed­er­al laws and rules of the Danville His­tor­i­cal Soci­ety. Users must indem­ni­fy and hold the Danville His­tor­i­cal Soci­ety, its offi­cers, agents, and employ­ees harm­less from any loss or lia­bil­i­ty which may result from claims of injury to per­sons or prop­er­ty from any cause aris­ing out of or dur­ing the use and occu­pan­cy of the Old North Church by User and User’s guests, agents, or employees.
8. Facil­i­ty Rental Agree­ment. Social ser­vice and com­mu­ni­ty ser­vice groups, indi­vid­u­als, busi­ness­es, and non-prof­it groups wish­ing to use the facil­i­ties shall be required to exe­cute a Rental Agree­ment for each event.
9. Ter­mi­na­tion of Rental. The Danville His­tor­i­cal Soci­ety, or the Old North Church Com­mit­tee, its offi­cers, agents and employ­ees shall have the right to enter and be present at the premis­es at all times dur­ing an event to con­firm that the user is com­ply­ing with the terms of use. If the Danville His­tor­i­cal Soci­ety, or the Old North Church Com­mit­tee, deter­mines, in its sole judg­ment, that the user has breached a term, the Danville His­tor­i­cal Soci­ety, or the Old North Church Com­mit­tee, shall have the right to imme­di­ate ter­mi­na­tion of the use of the rental agree­ment pri­or to the expi­ra­tion of its term and pri­or to the con­clu­sion of the event with­out any refund to the User.
